Hi - The Pre-Removal Risk Assessment (PRRA) is an application for Protection - not unlike the refugee claim. The CBSA initiates PRRA when they believe that they can successfully remove a person from Canada.

The purpose of the process is to see if any risks have arisen since a final negative determination of a refugee claim, and you have to provide evidence of that risk or there's a very strong possibility of a negative decision.

If you want to increase the possibility of remaining in Canada after a negative refugee decision then the most common approach is to submit an application for Humanitarian & Compassionate (H&C) consideration. You HAVE to get this in before the PRRA decision is made to enhance any chance of avoiding removal.

There are all sorts of details about both of these types of applications but very briefly, PRRA only looks at risk of persecution with precious little discretion for the same decision-maker who would decide any accompanying H&C application. H&Cs look at a wide variety of matters, like the best interests of the child, establishment, commitment to Canada, etc, etc.

The single decision-maker who reviews both applications (H&C and PRRA) therefore has far more latitude to waive any requirements of the Immigration Act and permit a person to apply for permanent residence in Canada without being removed.

In a nutshell, apply under H&C and hope for the best.

Thanks…I will definitely see my lawyer this week and will do the H&C before the decision can be made I’ll keep on trying..do you have a lawyer referral?
