Hi guys. Something is not clear . For instance, let's consider a case.
With my PR card, I stay for 10 months in a 4 yr period, so at that point I still have 1 yr left in my PR. But even if I stay the full 1 yr (5th and last year on my PR) , I still do not meet the Residency Obligation (RO), as max I can get is 1 yr 10 mnths and not 2 yrs in this 5 yr period of my PR.
Now my question:
(1) Will the Border official stop me from entering Canada the final yr as they could calculate that I cant meet the RO in my existing PR?
(2) But just in case I am allowed to enter Canada and continue to stay for 2 yrs(without renewing PR, if that is a possibility at all), then will I be able to renew my PR( which by then would expired a year ago) ?
1. You will enter anyway, however, there is always a possibility to be reported if you don't/can't meet the RO.
2. You don't have to have a valid PR card to stay in Canada. So, wait to meet your RO, then apply to renew your PR card. Don't attempt to renew the PR card without meeting the RO. BTW, the expiry date of the PR card is irrelevant to RO as it is calculated from the day you landed anyway. Good Luck!
They will start the process of revoking your PR status. You will have the right to appeal if they do. Any time spent in Canada, once you are reported does not count for RO until the appeal is determined.
