IF MYSELF AS PRINCIPAL APPLICANT DO NOT MAINTAIN MY PR STAY OF 2 YEARS OUT OF 5 YEARS AND MY WIFE & KIDS MAINTAIN THEIR PR STAY PERIOD.WHETHER MY WIFE/KIDS WILL FACE PROBLEM IN RENEWAL OF THEIR PR AS I AS PRINCIPAL APPLICANT FAILED TO MAINTAIN THE PR STAY NORMS ?

If your wife and kids comply with the residence requirements then they can renew their PR cards. Should not encounter any problems.
 
Hi

I landed in Canada with wife and child in July 2014 and got our PR cards effective till Sep 2019. I am planning to send my wife and child who are still Indian passport holders and having valid PR till Sep 2019.

1. They will go to Canada in March 2017 i.e. 2 years and 4 months before their PR ends. Will they face problem to enter Canada. Have they not met the residency requirement?

They should be fine. They need to go back at least 2 months before it expires. But I would not play loose with the timeline. The earlier they can go back, the better. March 2017 is good. don't stretch it until end of June

I just had one follow-up question. I have taken up Portuguese nationality this year. I want to continue visiting my family when they move to Canada in Mar 2017. Since my PR card is valid till Sep 2019 can I surrender the PR card at the USA Canada border and enter Canada as a visitor several times for the next 3 years on my visa exempt passport? Do you see any situation where they could debar me from entering if I have been honest in my dealings throughout?

I heard Canada citizenship time will be reduced to 3 years? Can they stay for 3 years and apply for citizenship and leave Canada to join me in Abu Dhabi or do they have to continue staying till they receive Canada passports. My child is 7 years old.

FYI - you can no longer enter Canada on your passport alone. You need to apply for an ETA.

If they apply for citizenship and then move outside of Canada, this will likely extend the processing time and may create challenges being approved. Keep in mind that they have to continue to meet the PR residency requirement while their citizenship application is being processed. Additionally, both the test and oath notices can only be sent to an address in Canada and you're often give little notice to appear (so your wife would have to be prepared to travel back to Canada very quick and with little notice).

Thank you for your reply. But I think what you said is partially true.

As I understand that ETA is only for travelling by air. If i go from Abu Dhabi to Niagra falls airport in USA and take a taxi from USA to Canada by land border I do not need ETA. I will surrender my PR and enter Canada as a visitor on a visa exempt passport. is that not possible? will they deny me entry because I am PR holder and volumtarily renounce it.?

You can continue to enter Canada on your still valid PR card by land or by air as you wish until such a time that immigration starts giving you problems about not meeting the RO. When they do and you know you don't meet the RO and aren't going to fight it, you can renounce your PR status on the spot and enter as a visitor. After that, you will lose your PR status and as a Portugese citizen, you will be able to apply for eTA and fly in or you don't get the eTA and travel by land.

In the case that immigration never figures out on entry that you don't meet the RO and you continue travelling on your PR card until it expires, you can also renounce your PR by filling out a form or you can travel from the US to Canada by land as a PR with an expired card.
