Hello Mates,
I would appreciate if anyone can help me out on this please.
My wife is the PR card holder of Canada but her PR is expired in current month. She spent only 15 days in Canada, Unfortunately after that due to some issues she hadn't been able to travel to Canada and complete the required time period.
She got the PR card before her marriage and now she is married and having two children ( Age 1 : 4.5 years and Age 2 : 1.5 years).
Given she has failed to meet residency by not spending 2 years out of 5 in the country she will probably need to renounce her PR and start again with a new application given with any other alternative she would probably be reported and immigration would renounce her PR for her.
She is in violation of the residency obligation for what is most likely personal reasons, so any interaction with IRCC or CBSA would most likely just end in her own PR status being revoked.
If she herself can somehow make it into Canada without being reported (either flying before PR card expired, or crossing via USA land border after it's expired), then technically she can stay inside Canada for 2 years to come back into compliance with the RO and only then could sponsor you and the kids. If you could get TRVs approved you could come visit, but there's a good chance she would need to stay separated from all of you for around 3 years in this case. So probably not a realistic option.
Best direction is probably to just renounce her PR status, and see if she or you qualify to apply for PR again from scratch.
