My parents PR expired in May 2014. They have spent 1 year in Canada so far (2013-2014). Now they want to come back to Canada. Will it be a problem if I drive them through buffalo on their expired PR card and using landing papers?
What can possibly happen in worst case scenario? Is it a strong case for renewal eventually under Humanitarian and Compassionate grounds as they have no one there.
P.S . Me and my brother their only children are both in Canada and are Canadian Citizens. We both are planning to go and get them through buffalo border.
It's difficult for any of us to say what their chances are of re-entering Canada without issues.
Worst case scenario they will be reported for failing to meet RO and have to appear at a hearing to argue why she should be allowed to keep their PR status. The reasons you have stated (ties to Canada) are not strong reasons for an H&C claim. For H&C to work, they will need to show evidence of the circumstances that prevented them from returning to Canada earlier to meet RO. Strong examples of H&C could be a serious illness that kept one of them hospitalized or too ill to travel for a prolonged period of time and therefore unable to return to Canada.
