Post Graduate Work Permit Extension Refused - What to do to restore my status so i can temporary live in canada

Hi,

My Post graduate Work Permit expired on 29/June/2024 - I had applied for Work permit Extension on 23/June/2024 before expiry. I had recently got refusal on my workpermit extension application on 06/Nov/2024 - I now have 90 Days to restore my status - I would like to apply for TRP and restoration of status - I am confused on how to apply for both.

Questions -

1. When I had applied for my inital PGWP I also applied for TRV which is Valid till 29/Jan/2029 - It says Visitor and no. of entries MULTIPLE on Visa - If i leave canada within 90 days restoration period without applying for TRP and want to travel back to Canada for less than 6 months stay can i do it on my TRV visa? or I need to apply for TRP now?

2. Should I apply for TRP and Restoration of Status separately, If yes how to apply for TRP and Restoration - OR I have to apply for only TRP as it should restore my status?

3. I have TRV (29/02/2029) visa on my passport and I am currently in Canada on the 90 days restoration period should I apply for TRP too If I need to revisit Canada OR I can revisit Canada on my TRV visa I have?

4. Is applying for TRP important for people who are in canada on the 90 days restoation period.

Why TRP?

Change status to visitor, so you can remain in Canada as a visitor. You have a valid TRV but can always be refused entry if CBSA thinks you are trying to live in Canada.

This is why sometimes peoples visas get cancelled out of the blue

You are a visitor. If the CBSA thinks you’re attempting to quasi live here , they can , and it’s happened to others , they’ll just cancel your visa .

No warning, no discussion

Btw how were eligible to extend your pgwp ? Or were you “ buying “ time to stay in Canada ?

It'll be very interesting when and if IRCC figures this out. This "buying" time loophole probably accounts for thousands of temporary residents who refuse to leave Canada.

In this instance, it was just blatant abuse of their visa “ privilege.”

Didn’t even attempt to hide it . It was a fake request. They KNEW they weren’t eligible for the extension and put it in anyway and CONTINUED to work

Blatant abuse for something ( visa ) that is a privilege not a right as a foreign national

As mentioned by the Government, Canada does not owe PR to everyone here , nor should they expect it . And that’s the issue . People are expecting it, even to the point of abusing the system , as this OP

What’s more worrisome is that they are in a position at a big bank where one assumes accountability for their actions in there job . Adherence to rules .
They may want to revisit that section in there training . But they were/are with TD, so that’s a mute point when it comes to accountability & adherence

There really isn't much hope if you look at the numbers. The incentive is high to make false claims as it allows people to stay. If everything fails, people can just claim asylum and stay for years or decades. The whole situation is very unfortunate for both sides. 13000 students claimed asylum, it's alarming.

Unauthorized people who are trying to game the system and stay are clearly holding on to jobs which they are not supposed to have. The govt is blaming employers and consultants instead of even making effort to resolve.
