Hi every one , we need critical help plz
My wife refugee claim was rejected yesterday she apply refugee 3 years ago , we were thinking it will work but we were also ready to send the inland spousal last week , now what we should do also with the new refugee rules is she's able to appeal the decision? ,also its possible to appeal the removal order?
if we send the spousal application next week is there is any chance ? what chance we migh have at this point
Please help we are so desperate and frustrated
You can submit the spousal application, but be prepared to have them wonder why, if you have a genuine relationship, you waited until her refugee application was refused before submitting the spousal application?
If her refugee claim is deemed "entirely without merit", the new rules say that she would not be able to appeal the denial. I do not know if they have begun applying those rules yet, you can ask an immigration lawyer.
Be prepared for her to be contacted by CBSA to arrange for a PRRA (possibly) or for her removal.

Under the new rules she is not entitled to a PRRA. Probably her next call from CBSA is for removal arrangements. http://www.cic.gc.ca/english/resources/manuals/bulletins/2012/ob440E.asp

this must be very frustrating. why did you wait so long to apply for inland? regardless of her refugee claim outcome you should have applied earlier!
If you are eligible to apply meaning if you are a PR or Canadian citizen then you should apply as soon as possible. but they will probably ask more questions. you can also apply outland which is actually a faster process but your wife has to go to her home country and wait.
I was also a refused refugee, but I already received the 2nd stage letter and i'm waiting for my final PR interview. (me and my wife applied inland)
