Hi all forum members,
I need some advice for my friend which is very difficult to find on any other forums.Here is the case-
He applied his CEC application in jan this year and got maried in august back home & in august once come back In canada he added his wife in his ongoing application.
Now my question is there any way he can withdraw his spouse application from his file as there are things not working between two of them & he is also taking some advice from imm lawyers later this week.
Will it affect his processing application & please put some light if any one of you have any idea as he is going through frm very difficulr phase so I just wan5 to check as much info I can for him.
If any of you know any good lawyer abt this issue ...pleaee provide the detail.
He must include his wife in the application if they are married. He can only remove his wife from the application if he has filed for divorce and can provided CIC will documentation to prove that he is in the process of dissolving the marriage.
Yes actually both of them are in talking terms with their families but there is no idea how long gonna it takes them to take the divorce.Seems like at this moment he cant withdraw her application.

As you mention on your post at the time of biodata request can change status which I think comes after medical so till they ask RPRF he has the time to take the divorce documents & change the status.Is I am taking this right?

He can notify CIC at any moment till the last stage about any change in marital status.
If he is not from Visa exempt country even in the PPR ( passport request email) email they ask to inform any change in personnel status ( ie marriage)
It will for sure delay things since CIC has to make those changes in the application accordingly. How much i am not sure

I need to clarify one more thing that he just inform me that in his home country getting divorce is not easy may be its gonna take at least 6 months.So in that case he is thinking to talk with his wife to settle it down everything mutually till he gets the PR.My question is if he divorce her after getting the PR with his wife & then do the divorce so what will be the circumstances at that time
-Is the living together for 2 years rule will applicable on their case (which is under the spouse sponsership )
The first thing he should do is to notify CIC. E-mail would be fine. He should explain that he will follow this up with the required documentation, which should follow.
CIC will advise what you need to do. The first step is contact.
