Hello, my name is Iordan. I have a study visa question.

I am a Bulgarian national who moved to America when I was 16 years old with my parents. We entered illegally at the time but my father now has a pending asylum immigration hearing. Ten years have gone by and we are still waiting for resolution.

I was accepted to the University of New Brunswick and now have to apply for a study visa. I will be applying to the Canadian Embassy in Romania since they service Bulgarian citizens. The Canadian immigration authorities require the applicant's original passport, which I will send. But, it states that the passport has to have the appropriate visas in it. Since I entered illegally 10 years ago and don’t have any visas in my passport will it be a problem if I am applying to the embassy in Romania? I hope to remain in America and work while I wait for the visa to come in, I don’t want to move to Bulgaria unless I have to.

Thank you.

Do any of you think I can apply for a Canadian study visa in my country (Bulgaria) while I am living in America. I do not have permanent residence in America, but I have a work permit.

Hi,

In my opinion, whatever may be... you will have to mention, as to what you did, and where you were/ history in the past 10 years on the student questionnaire form to be filled along with the study permit application. So, you will have to truthfully mention, that you are a Bulgarian citizen, currently residing in U.S for past 10 years or so... whatever your residence status is...and mention whatever documents like driver's licence, social security, school/college passing certificates etc.. etc. you have in U.S and your dad/family head is awaiting decision on the asylum immigration hearing. And apply with your original existing passport. Since, I'm no expert in these kinds of specific immigration related cases, I'm unable to tell you as to what will be the ramifications, when the Canadian embassy comes to know about your current status/ history,in any case... you will need to mention the past history and current situation (of waiting for decision of asylum immigration hearing) truthfully, and show sufficient finances to prove you can support yourself in Canada. It's best that you immediately consult an immigration lawyer in U.S, hear what the lawyer has to say, and go ahead with your study visa application.

Best of Luck.
