I am a US citizen married to a Canadian citizen. I recently applied inland to be a permanent resident of Canada along with applying for an open work permit. In September 2017, I unintentionally overstayed as a visitor in Canada for a couple months which I declared on both of my applications. My question is, will I be denied the open work permit because of the overstay? I’m currently on a visitor record and plan to apply for an extension as well. Will the extension be denied because the overstay? Thanks!
If you overstayed in September 2017 and was not issued with a Departure Order.....and was able to return and allowed back into Canada.......I doubt your OWP will be denied because of the overstay.........you need to have a valid status when you apply for OWP approval but not for spousal sponsorship.......its good that you included the overstay information in your application.........relax.....your OWP will likely be approved within 4 months.......although, OWP will give you implied status, will advice you should apply to extend your visitor visa (visitor record) until OWP is approved, and don't over stay again not to make it difficult for you in the future.......your inland spousal sponsorship will be approved based on the proof and genuineness of your marriage/relationship.
