Over Stayed Visit in USA

I am a Canadian Citizen and I am looking to sponsor my Wife, who has overstayed her visa in the USA. She is a citizen of India and came in to the United States legally on a visitor visa. Will we be able to process her file in USA or will the file have to be transferred to New Delhi. She was legal in the USA for only 6 months only.

Whether she's legal in the States now or not is irrelevant because she was never eligible to have her application processed through Buffalo. She was not legally admitted to the US (initially) for at least one year. ND is faster processing than Buffalo anyway, but if there's an interview, she'll have to go there. Submit as much quality evidence of your genuine relationship as possible to minimize the necessity of an interview.

Hi. Iam going through the same problem.If possible file your application in New delhi.Even if you file your application in buffalo they would transfered you application to the immigration office in New Delhi. Even if you have all the document they ask for. I have every document like I-94, US visa, letter from guarantor, I-20. they not satisfy with the document.Right now iam going through though tough time. Hope this would help. Good luck.
