Hi everyone. I am in Canada trying to sponsor my husband. He was here on the work programs and overstayed. He has been out of status since Dec 2016. We know this creates a little bit of a problem but we are trying to fix this now. We got married in July and are in the middle of putting the application together. My question is...what to do about OWP application. I am getting conflicting information. I know technically after 90 days u cant ask for an extension or change of stay but I have also read that u can still put the OWP app in with PR app. Some have said to just include it with explanations for the overstay, some have said include it with a note not to process till after AIP. and others have said to wait until after AIP and given the chance to apply
My application is almost complete (except the OWP) and I need to know what to do before I send it in. I dont want to make the wrong decision

looking at the work permit/extension guides and applications, now im lost all over again haha
So do I need to include the note for them not to process it till AIP? Or is that just automatic??
Also , this common law declaration form....is that for marriage too? or just common law (without marriage)
Another question to anyone who can help. If he was here on the farm workers program and everything has expired and now out of status, ( way past the 90 days allowed )
what does he need to apply for with his sponsorship application? Im not understanding this Work Permit Application. Would it be restore status, extension, or just owp ? i dont get all this lol

Need your input again.
Looks like OWP is not granted if the Principal applicant (spouse) is eventually on implied status even if he/she had a valid status at the time of submitting the PR+OWP application.
You mentioned that work permit will be granted at AIP stage which takes 10 months or so.
Would it be prudent to apply for visitor visa extension so that the work permit comes as soon as sponsorship approval takes places which takes 3 to 4 months and not at AIP stage?
I got an email that sponsorship application is received. But after a month, my spouse will be on implied status. I was under the impression that OWP is going to come anyways as soon as sponsorship approval takes place. Should I get the visitor visa extended so that OWP comes on time?

I can only comment on one aspect of your application: common law declaration form is NOT required if you are married. Saves you a bit of work because the form needs to be signed by a notary.
