Hi,

I have recently got married and my husband works in University of Victoria, Victoria BC, Canada, as a post doctoral fellow. His is on a temporary resident visa (TRV) with a temporary work permit (The validity of his temporary work permit is from July/2014 to June/2016 and he will extend it by one more year in the month of march/2016).

As per the information provided in the CIC website, "your spouse or common-law partner can apply for an open work permit if you are:
1. Approved to work in Canada for six months or longer, and
2. Doing a job at Skill Level 0, A or B in the National Occupational Classification."

My query is: As I have mentioned before, my husband's existing work permit allows him to work in Canada for 6 months or longer but its validity is less than 6 months from today (in June/2016). Being his spouse, can I apply for an open work permit in this situation? (My concern is his work permit is getting expiring in less than 6 months from the date of my application)

1. No, as his work permit has less than 6 months to run. If he got an extension of his work permit, then you could apply for an OWP.
