Hello,
Request an advise regarding Canada PR.
Myself & Wife got PR visa in Aug 2010 and the expiry date is in May 2011.
Now my wife is pregnant and her due date is in June 2011 which is after our visa expiry.
Due to some medical complications, she is not in a position to travel to Canada before the visa expiry.
I have sent a mail to CIC with the details and yet to get a response.
Any guidance on how to proceed on this.
You have to land, actually you must land if you are the PA.Then in case the CIC refuses the extension, which is the most likely thing they will do, you can sponsor her under family class.
If you are not landing before the expiry date of your Visa , they will cancel your application and then you have to start from the Scratch Moreover it will give a Negative impression to VO.
On safer side, my advice is you land first before the deadline, complete all the formalities and come back or stay there for good. Meantime, I hope you get some positive response from CHC for your wife and she can join you later with the newborn
Second option, you can still fly with your wife (with a doctor's advice) she can deliver her baby in Canada. I have seen many women (with visiting/PR visa) travel to USA, Canada during their last stage of pregnancy so that they can deliver a baby and get a passport of that country (for the baby) right away.
A. If you are a principal applicant you should land, complete the formalities and may come back. Later on you may apply again for your family and it should be quite easy vs starting from scratch
If you
do not land and you are under old FSW1 noc list,
do not fall in new NOC ,
do not get an extension of your landing (chances are very remote as VO may ask you why you have not landed in August 2010 itself) ,
chances are less for getting the PR again
B. if your wife is a Principal applicant both of you should complete the landing.
Another important thing keep in mind that few provinces in Canada only provide free medical after 3 months of landing, so please buy insurance before you leave country.
Admitting I know absolutely NOTHING about the ins and outs of this problem from an immigration point of view, it is inhumane to expect this couple with pregnancy diffculties to fly back and forth at this time whether together or separately. There are plenty of months before their visa expires, so it isn't as if they have just been careless and left things too late to deal with. This is an unexpected health issue, and if it is too risky for the babe/mother to travel at this time there should be something that can be done. I am thinking along the lines of a letter from the specialist explaining the problem and recommendations that should be sent with their cover letter, but I am not sure TO WHOM they should address their request. Come on Bright Minds....help me out!
You need to leave this month itself for atleast a few days do the landing formalities and comeback. Buddy u got the visa I suppose after a long wait .Hence do not waste this chance. Next no airlines will allow ur wife to travel if she gets in her last trimester. Hence do the necessary now or u will have to start frm scratch.
Thanks everyone for the kind advice.
I am the principal applicant and my wife is dependent.
Request clarifications on the below doubts also:
1. Based on the above replies, my understanding is that I can travel alone anytime before the visa expiry and inform visa office that my wife is not in a position to travel. My doubt is whether it is OK if only one applicant enters Canada? Or is it mandatory that the dependents should also accompany at the time of first entry?
2. Please advice on what are the landing formalities.. How many days I need to be in Canada for the landing formalities ?
I don't think it states anywhere that the dependents have to come WITH the PA, only that the PA MUST LAND FIRST. I don't know the duration of landing formalities, but am sure someone will pipe up with them soon. Hope your wife is doing well and knowing that you can keep open your door to Canada must certainly help. All the best.
