Hi Everyone!
What a great site I hope i can get some information from you guys as I know that Guatemala immigration is useless at responding.

First let me tell you I am Canadian Citizen born, my husband to be is Guatemalan. (I am in the middle of a divorce and can't marry yet, but will be common law in Dec with my Guatemalan.) We are so happy to be two months pregnant. We are trying to figure all this immigration stuff out so we can be together especially with baby coming.

I think we are going to apply inland (stupid Guatemalan office being the slowest in the world! lol) and try and get him a student 8 mth visa. We will apply for the student visa before getting married, than a.s.a.p we will get married when i can. I currently live in Guatemala with him as a tourist, he is a military officer!

We are wondering,

1) Are there finical requirements as a spouse sponsoring?

2) Do we list the baby as dependent child?

3) Where do we mention about the baby and what if we send in application before birth?

4) We are trying to get the student visa for jan or feb 2011 so the divorce will be finalized, but baby is due feb 3, I can't work how can I prove I will support him? (are letters from family enough?) (I haven't been in Canada working for a while so no job contacts)

5 can we apply as common law and give marriage certificate after we are legally allowed to be married (so we can apply soon and get his work permit granted before he finishes school)

6)if we don't get work permit after 8 mths of study can he apply to continue to stay in Canada on maybe a visitor visa?

I hope I have asked all I need to ask but I know more question will keep coming up. Thank you to all who respond really looking for answers.

1) No, there are no financial requirements to sponsor a spouse

2) No, the baby is a Canadian citizen because you are and is not being sponsored and therefore not listed as a dependent child. If the baby is not born in Canada, you would have to apply for a citizenship certificate and temporary passport for it at the embassy.

3) If you send in the application before the baby is born, you don't list it although you could mention in your supporting documents of your relationship that you are pregnant. If you send in after the baby is born, include the baby in additional family information.

4) If he is applying for a student visa, he has to prove that he can support himself for the first year as well as take care of the tuition. I think it is 10,000 plus the tuition. The tricky part with applying for a student visa or any kind of temporary visa is proving that he is planning on returning to his homeland after his studies are done. With a Canadian wife, they may not buy that.

5) You could apply as a common law but other people's experience who applied as common law but mentioned that they were planning on getting married actually resulted in immigration putting their application on hold until the marriage took place so if you do that, maybe better not mention that you are getting married. You can send that to add to your file later.

6) After 8 months of study, he may qualify for a post-grad work permit. He can also apply to change his status to visitor.
 
Regarding Student Dependent Visa

Hi,
I am going to apply for student visa for canada for september session.I want to apply for dependent visa for my husband. Is it possible for me to apply for dependent visa with my student visa.If yes, then what is the procedure for that
 
When you apply for your student visa, you can list your husband on your application form as accompanying you. He can get a visit visa for as long as your student visa is granted. If you are both visa exempt to go to Canada as tourists, you can then apply for his open work permit as you arrive in Canada. If you are not visa exempt, you will have to do it after you are already in Canada, see http://www.cic.gc.ca/english/study/work-spouse.asp
