Need Urgent Help

My sister who is a permanent resident and has a canadian born child.Her husband sponsored her and she came to canada in 2009 dec.Her husband abused her and assaulted her and once she called a ontario police as well and even after a birth of baby girl he become worst coz her mother does not like girls.He cheated my sister and told her that he got job in dubai and they had to move,,,,she was not a cittizen and she wanted to stay in Canada but he forcefully moved his family to Pakistan (home country)and there he revealed that he doesn't have any job and he was just lying.He snatched the passport of her daughter from my sister and then one day his mother,sister and he himself assaulted physically and verbally my sister and sent it to my dad's home,,,,and does not give her any money for raising of a child.She contacted canadian embassy for the daughter's passport and they said go to your court and apply for custody,,,,now they have filed their case in court,,,but in our countries courts are not fair enough.So she is waiting and waiting and he calls her every week and threats her I will revoke your PR and you cannot move from here without my permission,,,,he abused her a lot on phone my father had a severe brain hemmorhage and cerebral infarction,,,now he is paralysed he got too much stress as he is an old person ,,,,,,Please help us my sister is in trouble and she does not want to leave her daughter there,,,,her husband is continously threatening her ..............where should we contact ,,,,,,,,,,where should we go???? he is a cheater too,,,,he has a lot of money on his credit cards to pay back ,,,,,that's why he does not want to come back, to canada,,,,,,please help us.

Unfortunately, I believe the embassy is right. She will have a hard time getting a passport without the cooperation of the father unless she can show full custody of the child.

In my opinion, she should tell the embassy the whole story. This is also in order to protect her PR in case she gets stuck in Pakistan so long that she does not meet the residency obligation any more.

Another thing she could try to do is to find her member of parliament, see http://www.parl.gc.ca/Parlinfo/Compilations/HouseOfCommons/MemberByPostalCode.aspx?Menu=HOC and try to contact their office and see if they can help.

I am not sure what else she can do. It was a very costly mistake for her to follow her husband to Pakistan. As you say, the law there is not on her side and she surely would have had an easier time with the courts in Canada.
