Hey guys.

Firstly thanks for creating such an awesome resource for people such as myself...I have read through the posts and just want some clarification.

I am in real trouble I think. My current 2 year working holiday visa expires November 19th 2010. I am from New Zealand. I worked at an company doing all manner of IT tasks for 15 months. Recently I have moved to a new company doing the same sort of thing. My NOC code is : NOC 2281-B.

They are trying to get me PR status and I guess the first step to this is an LMO They have just finished 1.5 months of advertising the job and 2 weeks ago submitted the application or whatever that you do at the end of the advertising period saying they want to hire me because no one else was suitable.

I know you guys don't make the decisions but are LMOs likely to be denied... I mean it seems to me HR have followed the process and I am in a NOC code that is sposorable as a skilled immigrant.

Should I be applying for my "work permit" now, should I wait so I can get this "implied status" thing that I have read about, or do I need to relax and wait until the LMO response comes back.

It is causing me some headache obviously as I just don't know what is happening and whether I will be here in Canada on November 20th. Any help would be massively appreciated as at the moment I feel like my life is a little "out of my own hands" and I really have no idea what is going on, which is what frustrates me the most.

Dont worry ... I can bet that you gonna be here beyond Nov 20 2010 and if everything works out well ... much longer then that

For your first question

Do LMO's get denied
Well they do sometimes if the employer doesnt provide the necessary documents to HRSDC giving them ample proof. HRSDC should be satisfied with the recruitment effort that your employer has taken to receruit a suitable candidate.So if they see that the employer has advertised on a public website and if they feel nobody was able to take the position.... it means there are chances that you will get a positive labour market opinion. Also if the firm is big in stature and has had previous successful applications for LMO that augurs well. So all in all as long as HRSDC is satisfied with recruitment efforts , you will get a positive labour market opinion. Also the fact that you are from IT might help because its a job thats in demand.

Well say God forbid your LMO doesnt work and you dont get any thing by Nov 15th 2010 .. I suggest you apply for a work permit even though you might get rejected because that way you can be on implied status and your current conditions will prevail so they will consider that you are still here on a holiday worker visa until you get a decision from them. As i am saying this ... I want to tell you that I am on implied status and my passports are been dispatched to India for stamping and moreover I have a pending decision from CIC for my work permit.

Also to let you know that your implied status can last for close to 60 days bcos thats the time that CIC takes to decide on your work permit. Good luck .. hope that answers your question

And yes ... you have control over how long you can live here ... if you play around the rules

i.e. I don't have to wait for confirmation that they received it?
