I'll start by explaining my situation as clearly as I can. I am on an IEC permit, and have status as a worker until June 19th.
I am really debating whether to apply for Inland or Outland sponsorship, sponsored by my Canadian citizen common-law partner. From what I've seen, the pros and cons are:
Outland
- Much quicker
- Can stay in or leave Canada without restrictions
- Right of appeal
- Cannot apply for OWP at the same time and get implied status to work until then
Inland
- Much slower
- Must stay in Canada (is this for the whole 2 years or whatever, or just until getting the OWP?)
- No right of appeal
- Can apply for OWP at the same time and keep working.
I'm actually starting to lean towards Inland because of the working part. I have a great job right now that I don't want to lose - if I applied for Inland and the OWP before my current IEC permit expires, would that guarantee that I could keep working through the application process?
I'd really appreciate your recommendations - the ability to keep working is very important. Thanks!
It sounds like outland would be the quickest option. Your visa office would be London and it's only got a 7 month wait until you became a permanent resident (plus the 75 days for sponsor approval). If you did inland, it's 11 months just for sponsorship approval which is when you'd get a work visa but by that time, you could already be a working PR.
However, if I get the Inland + OWP applications in before my IEC expires, I could keep working through the entire process without having to wait at all, right?
I know the wait time is a lot longer for the OWP, but if I could get implied status I can keep working right now until I get the OWP, right? Not losing any time to work would be good.
Hmm, I thought that if you applied for the open work permit at the same time as the inland application, that would allow you to keep working.
If not, then outland it is!
I believe you can, but you cannot get it until the sponsor is approved (correct me if I'm wrong), which takes longer than the ENTIRE process if applying outland.
Yeah, on its own it would take longer than the outland process, I get that part.
But I've been told before that if I was to submit both applications together while my current IEC permit is still valid, I would have implied status as a worker until I get the OWP, so I could possibly keep working while waiting.
