Hello everybody,

I've been living in Canada for four years. I came to do a two-year program here and my husband came with an accompanying spouse open work permit. When I graduated, I applied for my PGWP and asked for a work permit for him, which was approved. A few months ago we applied for an extension of my PGWP (I didn't get the full time because my passport was going to expire before) and once again asked for his. I am employed full-time in NOC A and sent immigration all the documents: employer letter, diploma, pay stubs, letter from college, previous work permit, etc. We are doing our process with an immigration consultant. We have even been nominated by the province and sent our nomination as well. The first time, they refused my husband's work permit because they felt like they didn't have enough proof that I was working full-time at a job NOC 0, A, or B (even though we had sent all the documents and even a LOE). The second time they refused it again and simply said he didn't meet the requirements, nothing else.

My immigration consultant says it's his right to have an OWP, since I have one. Is that correct?
Has this happened to anyone else?

Immigration consultant is wrong about the OWP being a right. Your husband has the right to apply - however whether he's approved is up to IRCC. Approval is not a right.

Have you obtained the GCMS notes to see the detailed reasons behind the second refusal? What exact evidence have you provided to show that you are working in a NOC A, B or 0 occupation? What was your husband's status in Canada at the time he applied for the second time?

Hi!

We haven't obtained the GCMS yet. I sent my employer's letter with my job title (Reporter NOC 5123 - A), job description, and salary, plus six months of pay stubs, and also my diploma. His status was restoration because he had been denied the first time.
