Background

Canadian man falls for a Costa Rican Woman and marries her....Aug 24, 2014.

Here is the scoop.

Her current Canadian visitor visa (multiple entry) expires on March 3, 2015......we have all the forms filled and ready at the lawyers office. I am quite detail orientated when needed and know they are ready to go within hours.

She is currently in Costa Rica.....where she applied for the temp residence visa....we were honest and truthful and told the immigration office we were married even providing a marriage certificate. She was denied - we should have known this. Honesty is the best policy?

What are our options?

Can she come back to Canada....we file the inland papers for her residency and a visa extension and carry on until the process is complete. Do we have time to do this I realize time is tight? Or will she be turned around at the Canadian border as we have already made our intentions known.

Do we start an outland process? Guatemala is notoriously slow and currently has a 29 month wait....

Any help or information would be appreciated.

The TRV she has that's expiring in March, does NOT guarantee her entry into Canada. CBSA will still want to make sure she truly intends to leave when that TRV expires, so they may request to see a return airplane ticket, ties to Costa Rica, etc. If you tell them you intend on applying for inland PR upon entry, even though that's perfectly legal and acceptable, there is a good chance they will refuse her since her "intent" is to not leave Canada.

Also I don't know if CBSA will have access to the fact that she has been rejected already for a new TRV. If they can see that info, it makes chance of being refused entry much higher.

Outland PR apps for Costa Rica citizens are processed in Mexico City (Guatemala is for TRVs). Mexico City is showing 17 months processing but that is not an average time and most apps are done quicker. Look up the Mexico City thread in family class forum to see people's recent experiences.

Very informative and I know you are correct in the chances of being turned back. I am still thinking it is worth a gamble but will let my wife have the final say in the matter.

Why do have a immigration process in place that is so contradictory? It should be a whoops bad idea go back two steps and reapply but noooooo.....now you have to become desperate and sneaky even tho you are trying to play by the rules.
