Hi all,

I am not sure if my case should be posted here.

I am a Taiwanese girl and my bf is a Canadian chinese.
He has just finished his grad school in USA and he thinks it's time for us to end the long-distance relationship.

I don't mind following him whenever he goes, but now the situation is... he is recruited by a US company and now applying for US work visa (H-1B), so he is gonna staying in USA for at least two years.

If we get married in Canada, can I follow him to go to USA?

Hope I didn't make things too complicated.
Your advice is very much appreciated.

You'll need to ask this question on a US forum since this forum is for those moving to Canada. I suspect you won't be able to follow your boyfriend to the US unless you are common law or married. However you should check elsewhere.

Here's a link to a good US forum:

Yes! Your bf/husband can apply for a visa for you to follow him to the US after you guys get married. The visa is very limited though. You won't be able to work in the US or even study. So I'm not sure if that will be an issue.

If you are married and he is issued an H1-B, you will be issued an H4 visa. These visas are usually issued at the local US consulate office abroad. However, if the person is already in US, he or she can obtain H-4 status by filing Form I-539 for change of status. H-4 visa holders cannot be employed, but they can hold a driver's license and open bank accounts.

Why is he applying under H1-B and not TN, which is granted to workers of Canada and Mexico and is much faster and less expensive to get?

US does not recognize common-law relationship. Given that he has temporary status, you must be married or you can apply for fiance visa and get married in the States within 90 days of your arrival.

The OP does not qualify for fiance visa as the spouse is not a US citizen.
