marrying in 3rd country

Hi friends,
I am a canadian PR originally from India, currently living in Canada.. I was married in India but got divorced in Canada. I am now in relationship with a girl from India. Unfortunately, Indian courts do not recognise foreign divorce. In addition, divorce process in India goes on for many years unless both parties agree for divorce by mutual consent. My ex is not willing for divorce by mutual consent and want me to suffer rest of my life.
We applied for TRV Canda for my future spouse which was rejected 3 times
Common law relationship is also not feasible for us because it is not culturally acceptable in our society back in India.

My question is if we marry legally in 3rd country , will that be recognised as legal for sponsorship under spousal class PR to Canada.

Yes marriage will be recognized. Did you sponsor your previous spouse? If so you have to wait 3 years before you can sponsor again. Anticipate more scruitiny when it comes to a second sponsorship. Hopefully you have spent time together in person on multiple occasions.

No, I did not sponsor my previous spouse. yes, we have spent lots of time together and with each other's families as well. We have lots of proofs of our relationship.
My question is: she will return to India after marrying in 3rd country. And her application for outland PR will be processed in India. Will visa officer say that we did not had capacity to marry as my divorce is not recognised in India.
As far as I have read on CIC website; marriage is valid if it is recognised as per Canadian laws and the place where it occured (which in our case will be a 3rd country)
Another question: For this marriage, only close family members like parents will be present and there will not be many guests in the wedding. Will it also raise questions during processing of the PR file.

Would just explain the situation. Your Canadian divorce is not recognized by India so you had to go to a 3rd country. Because you had to go to a 3rd country many people were not able to attend. I would make sure you research what is required by the 3rd country to get married and have it registered.
