Does anyone know if marijuana possession charges (small amount, less than 7 grams) are considered an indictable offense in Canada now that the drug has been legalized nation-wide? I'm in the process of applying to sponsor my husband into Canada from the United States, and he has a marijuana possession charge from 2010 for which he paid a $600 fine and went on his way. It's considered a Class B misdemeanor in Texas where it happened. If it is an issue, I know I can fill out the paperwork to have him deemed rehabilitated as it's been 9 years since it happened, but am unsure if the new law applies to things and kind of "expunges" the charge that happened pre-2018 legalization, or if they will apply the law as it stood in 2010 when the incident occurred? Thanks!
I think he is OK if it was 7 gr. Below is a site which explains the issue. It is actually kind of complex (at least I find it that way) so you should probably read it over. If it was a DUI it would be trouble but this is simple possession. Look at it this way; I was pulled over for a taillight and had 50 grams on the seat that was fully visible. He told me about the light and wished me a good evening. Not a word about the pot. I can carry over 30g because I have a Med-pot permit.
