Hi I am interested in Immigrating to Canada I am a American citizen along with my brother however my mother is not she came to the U.S illegally in the 1980s and due to Trump being elected we are weighing all of our options and Canada seems like a wonderful place. I am a college student and she works at a dry fruit factory in CA. Here's my question:

1. Can an Illegal/Undocumented Immigrant immigrate to Canada as a political refugee?

Thank you (sorry if I posted in the wrong category I am new here) cheers!

Your mother will not be recognized as a refugee.

As a college student, it is very unlikely that you will qualify to immigrate anytime soon.

I agree with the above.

Applying as refugees isn't an option. You don't qualify and will be refused.

To apply to immigrate to Canada as economic immigrants you must have legal work experience. As you have no status in the US, there's really unfortunately no way for you to qualify.

I do have work experience (1 year) and my mom does as well (3 years) the only one that doesn't my brother (under age)

Your mother's work experience will not be counted since it was obtained illegally. Your mother's options for immigrating to Canada are really non-existent at this time.

Since you are an American, you can use your work experience to apply if you qualify. However you cannot bring your mother or brother with you when you immigrate (you cannot include them in your application). If you wish to immigrate on your own, you'll need to research Canada's immigration options in the following link to determine if you qualify: http://www.cic.gc.ca/english/immigrate/apply.asp

Note that given the work experience you have - it's very unlikely you'll qualify to immigrate at this time.

If you manage to become a PR, it's possible you may qualify to sponsor your mother for PR 4-5 years after you become a PR. Once you submit the application, it will take another few years for it to be processed. So best case scenario, your mother "might" be able to immigrate to Canada by being sponsored by you in 7 years. There's nothing available to her now.
