One of my colleagues is incorporating a company in Canada. He is a permanent resident in Canada and has some IT contracts which has to be executed with niche skills, for which he may need to take foreign workers, since there are noone with these skills working in Canada. I would like to know that, can he apply for an LMO to get foreign workers on board? I have heard somewhere that one of the requirements of LMO is that you should have recruited certain number of Canadians in the past. What would happen in this case when the company is newly formed and it needs foreign workers to get started. Can he get the LMO?

1. Unlikely that amongst the 33 Million people in Canada that there aren't any with this "niche" skill. I doubt that HRSDC will process a LMO for a company that would employee only Foreign Workers.

This sounds like a scheme of one type or another. It won't fly.
IT professions went from "LMO exempt" to not on the list of "in-demand' professions in under 18 months. It will take a significant effort from the employer to stand even a marginal chance at getting an LMO for a foreign worker.
When I applied for a LMO back in 2007, one of the requirements was the employer had to have been in business for at least 1 year and had Canadian employees.
I have never seen anything that has altered that requirement but things may have changed.
