Hello Guys,

My wife recently renewed her PR card to update her new last name then after that we submitted our inland spouse application.
The legal name changed document we submitted is our Marriage certificate,her updated Drivers License, updated health card, updated name on SIN card information.

Name Before marriage:

First Name: Maria
Second Name: Leonora
Middle Name: Balagtas
Last Name: Soriano

Maria Leonora Balagtas Soriano (as show on her birth certificate, passport and our marriage certificate) or simple Maria Leonora B. Soriano

COPR and PR card: Maria Leonora Soriano
( I dont know why the middle name is not included but when she filled out the IMM form before or in the Provincial nominee application, she included her middle name, exactly show on her passport)



Name After Marriage:

First Name: Maria
Second Name: Leonora
Middle name: Soriano
Last Name: Andal

Maria Leonora Soriano Andal (As shown on her Drivers License, Health Card, Updated info on her SIN card)



Then Today she received an email from CIC stating that:

We have received your application for a Permanent Resident Card and note that the name on your application differs from that on your Record of Landing or Confirmation of Permanent Residence document. We are unable to process your application without proof of a legal change of name linking your name at landing and the new name you are requesting. Please submit a copy of all the applicable linking documents from the list below which link the name on your Record of Landing and your new name:

· Legal Change of Name Document
REQUESTED NAME: ANDAL, MARIA LEONORA SORIANO
TO ADD THE NAME SORIANO, YOU NEED A LEGAL CHANGE OF NAME DOCUMENT.
WITHOUT THE NAME CHANGE DOCUMENT, THE NAME: ANDAL, MARIA LEONORA IS THE NAME WE CAN GIVE YOU
***Please note: If your name change occurred outside of Canada then you must provide a copy of a passport or other national authoritative document that has been amended to reflect the new name and an official document linking the old and the new names.

Any document that would establish a name and is in a language other than English or French (for example, a marriage certificate, a birth certificate, etc.) must be accompanied by an official English or French translation. The documents must be certified by an authorized person and then the certified copies must be translated by a translator from an independent qualified translation service. The client will cover all costs related to the translation of documents.

What is the legal name changed do i need to give? i already gave the documents that is needed.

It sounds to me like she used her "new" name, but her PASSPORT has not yet been updated. If this is true, she should have used the name in her passport on her application.

In order to do her passport updating, we need to update our marriage in the vital stats in our home country which gonna take couple of months based on processing times (on its way) then we can update her passport after that.

she can't update her card until her name is legally changed. the name on the PR card must match the name on the landing document. unless you have proof it was ALREADY changed, just having an application to change your name submitted won't allow you to get a pr card in the new name. you will have to wait until her passport is updated so she can prove her new name, otherwise she will have to renew her pr card in her old name.

a common-law relationship certificate; or
a court order (i.e. separation agreement or divorce order/judgment) issued by a court of law in or outside Canada; or
a certificate to dissolve a registered common-law relationship; or
a resumption of surname certificate.
The document you submit to support your application must show the name you are requesting to have on your new passport.

my apologies for not understanding correctly.

it's sounding like the required documentation you sent to change her name dosesn't refelct the full name she desires. cic can't add "soriano" until you submit proof that is part of her legal name. it doesn't sound like your marriage certificate has "soriano" as her middle name, is that correct? if so, then how can they change the name to the one she wants if there is no legal proof it's her name? a driver's license, health card and SIN# are not valid legal name change documents cic will accept. you need to get her updated vital documentation (ie birth ceritificate or passport) of the name she desires.
 
You should remove her personal information from the post if that is her real name ...

In our culture once the lady gets married, her last name will become her middle name and her husband last name will become hers. all after marriage.

Andal is the husbands Last name.


As per CIC website, the one main requirement in changing names especially after marriage, is the marriage certificate.
We've provided everything, especially ID's here in canada. i dont know why they want this.

TO ADD THE NAME SORIANO, YOU NEED A LEGAL CHANGE OF NAME DOCUMENT.

We already provided the documents that proves.
 
it sounds like she wants her previous last name to replace her old middle name, correct? Usually, when people change their name for marriage, they drop the previous last name and have to legally change their name to what they want it to. using a marriage certificate to change a name generally only allows a person to drop their maiden last name and add the married last name. it doesn't allow people to shuffle the maiden last name to a middle name. a previous last name can't just become a person's middle name without legally changing it. so she has to change her LEGAL name to reflect what she wants it to be. does that make sense?

marriage certificate issued by vital stats MB province. Anyway i will check tomorrow with vital stats regarding this one.
