Hello, simple question. If I move with my family for a while once me and my partner have lived together for a year, can we apply for common law later without having to live together for another year? I need to go back to my home country (USA) for a few months, but plan on coming back after and applying for common law inland. Is this ok to leave and live in the USA for a few months then come back and apply? I'll have the necessary proof to show we have lived together for the year before I leave back to the USA for a bit. Thank you!

Yes. Keep in mind that when you apply for common law inland, you must stay in Canada until you have your PR approved. Otherwise, apply outland if you plan on leaving again after applying.

Great! In addition, you can include an OWP application on your spousal app if you intend to apply inland. This permit will let you work while waiting for your PR. The permit can take up to 4 months to be approved. Recent reports say it takes shorter than that.

Visit visa? I thought you are an American. Aren't you? Americans don't need visa, they have to extend their visitor status, though. When you come back after your supposed 3 months leave, if CBSA allows you to enter Canada again then no need to extend your status if you submit your app immediately, as the application would give you an implied status. However, if you submit your application nearing your visitor status expiry (usually 6 months after you enter Canada) then it is advisable to extend your visitor status.
Within just a couple of months? Also, for another 6 months we may get a room mate, so we can be in a nicer area, will they be okay with me submitting a common law app if we have a roommate on the lease? Thanks.
