Hi

I recently became aware of the 180 day rule which means my kids will soon be out of status from 26 Feb 2024 following entry in Aug 2023.
They have multiple entry Canada Visitor Visas expiring in 2025.

My Study Permit expires 31 March 2024 for which I have submitted an application to extend in Nov 2023 together with an extension for my spouses OWP.
It seems we will not hear back in time to submit an application for Visitor Records for the kids.

What are our options? We are in AB, and all have multiple entry visitor visas to the US. Can we go to the border to request Visitor Records on hearing back on my extension application?

When do your studies expire? You can attempt to go a land border if your children and at least one parent has US visas or are able to enter visa free. Normally I would not recommend going to the US because of the Risk of being denied entry but since you have states until the end of March they are likely to be able to enter and at least be able to visit until the end of March if not another 6 months. If your children are 4 or above you should apply for a study permit. We have seen many examples of visa officers denying TRVs and instructing parents to apply for study permits for their children instead. Once you have your PGWP and are employed I would suggest applying for study permits if your children are 4 and older. Would request that the expiry date coincide with the end of your PGWP.
 
My studies will be completed in May 2025. I have heard of many applications being denied if you leave the country whilst still in progress, so I cannot go to the US land border until then? Problem is if I wait, the kids 6 months are up and going after I get response, we might face other issues.
