Leon,

After long time, I am the same holding PR from Kathmandu, Nepal. We (me and my wife) both are PR holder of Canada. As your advice I had applied TRV for my daughter(she has born in Nepal) and it has been refused. Now I am applying another TRV (TRP of visa exempt country).

Do you have any idea about the fee? it is just TRV single entry $75 or TRP $200?

Can you please do suggest me to justify the CHC that I fall in humanitarian ground ?

What will be the possible cover letter format

What was the reason for refusal if you don't mind sharing? It's so strange they would refuse when you are both PR of Canada. Did you meet residency obligations?
 
of course yes!!

We became PR in August 2010 and stayed there for around 6 month than we have returned back to our home country Nepal. She has born here in Nepal and obviously my intention is to make my daughter PR so this is the process.......TRV has been refused but now they can grant her Temporary Resident Permit under humanitarian ground.

I know this much...and expecting the answers from expert.

Considering it's a TRP, you pay the TRP fee.

It's from my understanding. If you are applying for TRP, then obviously you pay the TRP fee. It's like buying a gallon of milk, but paying for the chocolate bar instead. It doesn't make sense, so you pay the cost of the milk.

It is NOT a TRP. Your child is NOT inadmissible to Canada. It's another TRV application. You can request consideration of H&C grounds in a TRV. Only pay the TRV fee.

I don't understand your reasoning. How can you "treat" this as a TRP? A TRP (Temporary Resident Permit) is an application made when someone is inadmissible to Canada for medical, criminal or security reasons or other reasons. I think I'm pretty safe in assuming that your child has not committed any crime nor gotten involved with any terrorist organizations. So how can you justify applying for a TRP? Where did you even get the idea that a TRP was the right application?

Since you only stayed in Canada 6 months, then you haven't met residency obligations yet. And now your down to 27 months within which you must reside here for 18. We'll see if others corroborate, but I'm guessing if you simply re-apply, that will also be refused. You have some tough decisions to make.
 
Dear Frinds,

I would like to thank all the friends who has helped me out here in forum. My daughter has got TRV visa and I am in plan to move towards canada next months.

I have suffered a lot in this process so I just want to suggest that the TRP is not for us who are not visa exempt. TRP is only for the people who are inadmissible and falls under Visa Exempt country.

If the child born outside from PR holder parents than the best way is to apply TRV, it may refuse first time as your intention is to make your child PR and TRV is temporary resident visa or tourist visa only for certain time. So now you have to apply next TRV including first rejection letter with explanation why your case justify that you have to go Canada.

Now you will definitely get TRV for your child on humanitarian ground. If again not granted the visa than one of the parents have to go early to sponsor your child.
