I’m a Brit who married a Filipino in the Philippines in 2009.
Long story short, she cheated on me and we separated in 2012. I now reside back in London.
We never divorced. I have recently discovered that she has immigrated to Calgary Alberta.
She plans to bring her boyfriend over (the person she cheated on me with) and marry him.
I have not agreed to a divorce, or ever will.
I know for certain that she made copies of my passport when she tried to gain entry to Europe. UK Border Force and Interpol put a stop to this. However I believe she used these documents to gain entry into Canada. She works online as a blogger and has never paid any taxes. Her mother has taken her in.
I was under the impression that as her legally married husband I had to be contacted if she wished to move permanently to Canada, is this correct?
Can some kind soul help me?
TIA

No, you are separated. She will need to declare when she was married to you and when you separated but as you are not part of her immigration application, you will not be contacted. Having a copy of your passport will not help her gain entry to Canada either.
She can sponsor her boyfriend as soon as they are common law (live together for a year). She can also process a divorce without your consent. Seeing as you have been separated since 2012, no reasonable judge will prevent her from legally severing your marriage.
How did she immigrate? Her mother would not be able to sponsor her if she is married and over 21. How do you know she hasn’t paid any taxes in Canada. She could apply for common law sponsorship if she lived with her partner for a year.

No - certainly you do not have to be contacted if she wishes to moe to Canada permanently. She can move wherever she wants without notifying you or without someone notifying you. You have no right to know where she is or what she is doing.
Note that she can eventually divorce you without your your agremeent. It's probably already possible give you have been separated since 2012. There are also a few ways in which it would also be possible to bring her boyfriend over to Canada depending on the circumstances.
