I am an international student, married to a Canadian. I got a criminal conviction for driving while suspended license on june 18th 2013. my wife was also charged for some theft like 4 years ago but she was never arrested; not a violent crime.
she wants to sponsor me. am i eligible as an applicant and is she also eligible to sponsor me. the marriage is legit. and we have been living together for a year and half (18 months ) we have proof of rental receipts and letters from land lords saying that we lived on that particular place. and we also have joint bank account. we got married two months ago.. like on 28th july 2013. my study permit was recently expired and i applied for a new one, just a day before its expiry, and its still in process.
also, we dont have much pictures together not even wedding pictures.. can this be a problem?
any suggestions, advice, replies would be greatly appreciated.
Expecting a straight answer in 2 hours is unrealistic.
A very simple search can direct you to this doc which contains more information regarding criminality for immigration: http://www.cic.gc.ca/english/information/applications/guides/5312ETOC.asp
As for your wife charge, I am unfamiliar with the sponsor having some criminal history: If nobody in this forum provides more insight, I think it would be worth it for you to consult with a lawyer as crime context such as age and any aggravants of your (and your wife's) charges may be decisive for your application. good luck!
I believe since this is a criminal conviction (not a highway traffic act), then you need to wait for 5 years and then apply for rehabilitation before you can become eligible for PR.
Though not certain here, so as always with criminality issues like this its always best to talk to an experienced lawyer on the subject.
