Hi everyone, hoping you can give me some advice...

I am a Canadian citizen, husband is from Holland, and we live together in Europe at the moment. We also have a 2 year old whose Canadian citizenship is being processed at the moment. Our plan is to settle in Canada, arriving this summer, and applying in-land.

I am a bit worried about what to say at the border (Vancouver airport). Do you mention your intent of sponsoring? Our plan was to say we will be visiting (hubby will have a return ticket) and then, if asked further, we will say we are going to do an in land sponsorship, but we are fully aware of the rules that he is just visiting until he is fully approved. Does that sound okay? Any wise words??

You can do this, but why wait?

You could apply as outland now and your application would be well underway by the summer. You can then land your husband under 'dual intent' and wait in Canada for final approval. Stuff on that here:

You should (must) get your child a Canadian passport once the citizenship comes through and travel him / her on that.

Thanks so much for your reply. The reason we wanted to apply inland is so my husband would be able to avail of the open work permit. It's my understanding that you can only get an OWP through inland application, correct?

That's correct, but the OWP takes 4 months to issue. So if you were to apply outland now, since outland processing is often faster than inland, your husband could be a PR around the same time (or shortly after) he would be getting his OWP if you applied inland.

For example - if you apply outland now (March 2018) there is a good chance he would become a PR by the end of the year

If you moved to Canada and applied inland in, say, July, he would not be able to work until November anyway, then would have many more months to wait till he became a PR

The majority of outland applications are processed in less than 12 months, but 12 months is the processing "standard" that IRCC holds themselves to.

That is the 'official' line from CIC. The reality is somewhat different! For real-world outland spousal sponsorship timescales, please refer to the spreadsheet link in my signature line. For London Visa Office and visa-exempt applicants, more like 6 - 8 months start to finish, but it is a 'bell curve distribution of course!

It's a bit complicated - before Dec 2016, worldwide processing times were vastly different. Some outland apps took years, some would regularly resolve in under 3-4 months. Inland apps typically took 2 years+ (and that's why they started the pilot program issuing work permits, because the inland apps were people already in Canada, and they were being blocked from working for years).

In Dec 2016, IRCC instituted a new global 12 month target. Inland, outland, anywhere, 80% of apps were to be done in 12 months or less.

Some outland apps are now a bit slower than they used to be (basically, the ones that were quick), some are now quite a bit faster, and inland has come down a lot as well.

Nevertheless, in your situation, I'd be surprised if an outland app took more than 9 months, or if an inland app took under 11 months. In addition, you couldn't start an inland app until you get there later, and he'd have other obligations (eg not being able to leave Canada while it happened, potentially having some risk of getting in in the first place).

I have already sent my app in November 2017 inland and submitted schedule A in February . It is a inland application and it’s been 4 months now 5 th started
