Hi i need some advise. I have been a PR in canada last july 2013. I was single back then but i have a boyfriend from phils for 2 years already. Last may 2013 before i landed, he went here as a worker we lived together for 2 months before i got my residency. Does that count as commonlaw? Should i made the wrong decision when i made my landing that i didnt tell them i am living with my boyfriend for 2months. We married last dec 2013. Now i am sponsoring him as a spouse. Would there any be a problem abt that? Thank you so much.
To be considered common law you must have lived together for a minimum of one full year.

Yes, that's correct. You were still single at the time. To apply as common-law now, you will need to "prove" it, with things like joint bank account, both names on rental lease, utility bills, etc. etc.

Truesmile in ur opinion, so i didnt misrepresent myself before I landed right? Because i just realized now after reading all internet forums abt spousal sponsorship that could happen? We were living together for 2 months before i got my residency or landed or went to saskatoon that time. But when my bf ( soon my husband) joined me here in lloyd we opened joint savings account so that was 2 months before i got my residency. I am so confused. I am scared that they might see our application and conclude i misrepresent myself. Thank you
Two senior members have both told you that you did NOT misrepresent yourself, unless there's more to the story that you're not sharing here.
IF you EVER lived for 1 year continuous (not 364 days, but one full year) with a person in a conjugal, or marriage like relationship, then you would potentially have a problem. Since you say that your had only lived with your husband for 2 months, before your landed...you have nothing to worry about. Having a joint savings account has nothing to do with common-law.

Thank you Ponga. i have another question. In our application we sent our marriage certificate that the judge only gave us that time because we only had a small wedding in a court. Would that be a problem? Because i just realize that there is another certificate that comes from vital statistics.. And if cic decides its not the right document will they just send an email requesting for the other one the one ordered from online? And another thing the option c i sent (i am the sponsor) is just the one i printed off from the cra website of my account. Would that be a problem?
You needed to request an official Option C from CRA, not print something from your account. This may be a problem, as an official Option C is required, per the checklist.
You should order this from CRA ASAP and forward it to CIC once you have a file number, so that they can hopefully match it with your application.
if CIC does not like the validity of the required documents you will receive notification about it. There are 2 ways they do this: 1) return your application or 2) send you a letter asking for the documentation and giving you a specific period of time to submit it. I agree, you may want to at least order the original option c from the CRA just in case they don't consider the print out valid. I'm not sure I agree to send it to them without them asking, because that can cause confusion and delays. Best to wait until they ask!
Thats sad Ponga cause we are in a rush to pas sthe package however I just received an option c yesterday will i wait for my file number or have the option c send today to mississuaga?
