IMM5604E - Declaration from Non-Accompanying Parent/Guardian for Minors Immigrating to Canada
This form needs to be filled out by my wife's ex-boyfriend, so that her biological daughter is allowed to come to Canada. However he is in prison and will be for...let's just say...a very, very long time. They are all Mexican citizens, and currently living in Mexico. It requires his signature on this document, in front of a witness at the Nortary Public.
1) How can he sign when he is in prison? Will a member of the Nortary Public travel to see him and witness the signature?
2) I'm assuming this document needs to be translated to Spanish for him to sign, by an official certified translator.
3) It asks for his National Identification Card. If he doesn't have one (it's lost or simply unavailable) then what do we do?
Is he willing to sign? If yes, can your wife go visit him in the prison?
If he can read English, the form won't have to be translated. Ask at the prison - maybe there is someone there who is the equivalent of a notary public and can witness such things. If not, then find out if a notary public can visit the prison to witness the signing. Lawyers are notary publics in Canada - maybe they are in Mexico too.
If he is in prison, then surely a record of his National Identity Card is on file.
I realize prison authorities may not be helpful, but I would have your wife start by asking them about how to do this. She may need a lawyer.
So he signed a written letter my wife wrote, but I'm certain the official document is the only thing CIC will care about. Since the ex-boyfriend speaks only Spanish, and CIC only accepts English or French documents, we will need both the English and a certified translated Spanish copy of the document? They'll both have to be notarized.
Yes, I would think that both the English or French form and a certified Spanish translation would be needed.
Try contacting the Mexican embassy in Canada to see who can certify documents in Mexico. I found this, describing what a notary public is in Mexico, if it is of any help:

getting dead beat parents to sign is def. a struggle. My family is based in UK, and my wifes son's dad has had nothing to do with him since he was 2, he's almost 16 now, we hunted him down through his family and got a written letter him consenting to travel abroad and aware of his attentions to go to canada, and we turned it into a statutory declaration and certified by a lawyer. Being he was born before 2003 before rules changed in the UK, the mother unless a legal document was done between the 2 (which wasn't) automatically gives her full custody rights to him and is free to travel abroad. Good research pays off too since each country is different, maybe there is other options as well. Good luck to you, hope all works out.
