My sister is a single mother with 100% custody of her child. I had applied for express entry for her and my niece few months back. Today we received the following message from CIC.
IMM 5604 Declaration: Please submit a completed Declaration from Non-Accompanying Parent/Guardian for Minors Immigrating to Canada Form (IMM5604) for. Note that a photocopy of a valid and legible identity document of the Non-Accompany Parent/Guardian must be included. This must be received at this office by: 2016/05/12
My sister got divorced 2 years back and has legal documents from the court that she has custody of the child. Will those documents be enough? The reason I am asking this is because we don't have any idea where her ex-husband his.
So if we upload those custody documents, are they enough or we would require a separate document in which the ex husband provides a declaration. The existing legal documents are signed by him and also notarized.

Try replying with all available legal documentation which conclusively proves that your sister is legally divorced and has full custody of the child. Her ex-spouse shouldn't be a part of this application so there should be no requirement for their medicals or PCC. You must provide a photocopy of that person's identity document though as IRCC explicitly asks for the same here.

Thanks Asivad. Yes, she is legally divorced with full custody of the child. Ex spouse isn't included in the application. Only my sister and her daughter are included. Will also provide photocopy of the ex husband's identity.
The court document showing she has full custody will be enough. CIC just needs to make sure that she has the legal right to bring the child to Canada so that they are in compliance with rules regarding international kidnapping.

Strangely in the email it is mentioned that a photocopy of this particular form is required. Now we have no idea about his whereabouts, so that form will be almost impossible to get signed. So at max, can send the legal custody document and nothing else...
