Hi Guys
i just would like to ask you some additional information if possible

I am sponsoring my partner as common law...I am a Canadian permanent resident and we lived for more than 1 year in France (where He lives and where I can work and live without visa as an Italian citizen)

I have some questions concerning the paper IMM5409 STATUARY DECLARATION OF COMMON LAW UNION

1) COUNTRY AND PROVINCE (IF APPLICABLE) : DO WE HAVE TO PUT THE CITY AND PROVINCE WHERE WE WANT TO LIVE ? I MEAN I AM A PERMANENT RESIDENT IN QUEBEC SO SHOULD WE PUT MONTREAL QUEBEC?

2) AFTER we...(our names ) of (city, county, province and state) should we put PARIS FRANCE (where we lived for more than 1 year) or a Canadian city where we want to live?

3) part 1: we are going to put NO to all these questions because
- the apartment in Paris is property of my partner, so my name was not on the lease,
- we have the phone bill and electricity bills under both names
- we do not have a joint bank account but we have both signature on each other s banks account as beneficiary in case of death...can be used as a proof in this case?
- life insurance: i (the sponsor) am under the french life insurance of my partner (the sponsored) ...I think that this would require a NO in the question 2 and yes on question 3 right?

in the third part (section 5) after my signature and my partner signature, there s written SIGNATURE OF COMMISSIONER OF OATHS...WHAT DOES IT MEAN?WHO IS THIS PERSON AND HOW CAN I FIND IT?
SHOULD IT BE CANADIAN? OR RECOGNIZED BY THE CANADIAN EMBASSY?
OR SHOULD IT BE A LAWYER?



I have another question on the questionnaire IMM 1344FA that I (the sponsor) have to fill in

in quesiton 9 : have u already been married or common law partner or conjugal partner?
I have had the PR while i applied as a conjugal partner with my previous partner...
here it asks information on previous relations (name of my previous partner) when the relationship started and ended
- the starting date refers to the date that I started the relationship with my ex partner or from the day that I had the residency? because i got the pr card on august 1st 2007 but my ex partner and me we started our conjugal partner relationship on december 2005...

he also asks me the address of this person..well since we broke up we have no contacts so I don t know where he actually lives and i don tactually care....

For IMM5409:

1. Yes, put your address in Montreal.
2. I would put Paris since that is where you lived together for 12 months and you just returned from there, right?
3. Sorry, no idea. I don't know what questions 2 and 3 are.
4. A commissioner of oaths is someone that is by law able to receive an oath. I believe a notary can do this, but not sure. Check here: http://www.justice.gouv.qc.ca/english/sujets/glossaire/comm-asser-a.htm


IMM 1344FA

They're asking about your previous relationship so they want the start and end dates of that. They already know when you became a PR. If you don't know his address, just put "unknown".

in the website that u sent me I saw that also a lawyer can be a commissioner of oaths....
i have a friend in montreal who s a lawyer ...can i ask him to sign when we come back to montreal?
I mean, it should be a canadian or a french to sign that?

If you have a co-signer, complete this form only if you and your co-signer are in a common-law relationship. A common-law partner is a person of the opposite or same sex who is living with you in a conjugal relationship and has done so for at least one year prior to the signing of the Undertaking.


I don t have a co signer.---my partner is not a co signer...so it means I don t need it right?

Correct.

Others will still recommend you complete it; we were told NOT to by CPC-Mississuaga and CHC London. It will not harm your application if you do choose to include it - or some kind of statutory declaration for your common law status.
 
In your situation you do NOT need to fill out this paper, so I wouldn't bother.

It would only apply if you and your partner were sponsoring either one of yours or one of his relatives to come to Canada.

anyway we decided to sign it...I mean, one of my closest friend is a lawyer so he can sign as a commissioner of oaths...is it ok if we also send it ? i mean, does it will harm our application?
i thought it could be a stronger way to show our relationship.....
