IMM 5604 advice

I am looking to sponsor my wife and her son for PR and looking for a bit of advice with regards to IMM5604. My wife has contact with the biological father is but he is not on any documents as the father and has never been part of their lives, and has not met the kid since he was an infant 9 years ago. Legally she is the sole parent/guardian of her child, will we still need to fill out IMM5604? I was advised by a lawyer just to get the signature if possible but that might actually require more paperwork on her end, plus potentially blood test to proof he's biological father before she can get a notarized document to say she's has sole custody which she already does legally. Can anyone with experience shed light on what's our best course of action? If I give a similar explanation to above as to why we did not get his signature sufficient? Appreciate any advice, thank you very much.

She may need declarations from the court that prove she have sole custody of the child, are a sign affidavits proving the father he is not apart of the kids life since the kids was a infant, last resort a sign form imm5604 form from the father
