Reading the forums here all I see is impossible, impossible, impossible. Yet everywhere I go I see skilled and unskilled TFW's who are working, did they just get in from the previous program or what is going on here? I mean really, step into most tim hortons and you can see most of the workers are foreigners. I'm just trying to understand if it is indeed so difficult how did these workers get visas?
My GF is from Vietnam recently graduated from University. She has found a small restaurant owner who wants to hire her as a TFW but unsure of the likelihood of approval for the LMIA if submitted. Can anyone give advice? thanks!
They could be new immigrants to Canada who can work in Canada just like you and require no work permits - and who are working a "survival job" while they establish themselves. They could be open work permit holds (there are a number of different ways to secure an OWP) which doesn't require an LMIA. Or, crazy thought, they might be Canadians by birth.

If the restaurant owner has tried and been unable to hire someone already entitled to work in Canada, it's quite possible the LMIA may be approved. Make sure the employer understand the advertising requirements and has fully met them - along with what will need to be submitted with the LMIA application, including the $1K fee.
How do you know they are all TFW?

Students (who are allowed to work 20hrs a week)
Spouses on a OWP while waiting for their PR (inland application)
I believe refugees are allowed a OWP while they wait for their process (someone correct me if I'm wrong)
Recently landed Permanent Residents
Or maybe... they are Canadian citizens!
