I am an Indian citizen currently holding Canadian PR and eligible to apply for Canadian Citizen in April 2019. My GF is US Greencard holder and we are looking to get married to be together. Ideally I would want to move to US to her and would need guidance from this forum in that regard.
1. Should we get married in US or Canada. If in US, how much time would it take for me to eligible to work in US?
2. During the time when I am not authorized to work in US, can I return back to Canada to work?
3. Do we talk to immigration lawyers before or after we get married? Or is it even required?
4. If either of us moves, we need to look for new jobs and in that perspective what should be the right way of going about.
I would appreciate if anyone or someone who has been through this can guide us to give us some sort of confidence as there seems so much of complexity. Looking forward to some insight. Thank You!
1. You are asking in wrong forum. This one is to immigrate to Canada not to USA.
2. As long as you are PR resident you can work in Canada
3. There is no law in Canada that does require this. It is up to you what you want
4. In order to work in Canada you either need to be a PR (which you are) or you need to have a TRV which allows you to work (that would be for your future spouse). So if she is not PR she will need a visa to work. Be aware that there are several options depending what do you intend to do.
And as for USA side, find a suitable info about it (Google is your friend).
You cannot immediately apply for a green card after marrying a US green card holder, since spouses of US green card holders are not considered immediate relatives. You would have to wait until your visa number becomes current. And while waiting (about 30 to 36 months), you won't be able to reside in the US, much less working.
Getting her to Canada would be much easier, since you can immediately sponsor her as your spouse, and she can work while waiting for her permanent residency while residing in Canada (Canada allows dual intent). This would obviously mean that she would eventually have to give up her green card due to non compliance (green card residency requirement is very strict compared to Canadian PR physical presence obligation).
If you are set on immigrating to the US, you need to go get married to her, file spousal petition, and then wait outside the US for 2 to 3 years before you can join her, during which time you probably would qualify for Canadian citizenship.
