Humanitarian and compassionate for parents refuse by CIC

I applied for my father he is in canada from last 4 years on super visa . His age is 82 years old and my mother was expired long years back. Due to long waiting time last year in nov i applied under Humanitarian and compassionate ground but yesterday i receive a letter from CIC that his case is not approved.

God knows why they refuse it, since i am only his son and i have sisters in india but they are busy with their families and cannot take care of father.

All my family in canada

Can anyone suggest what should i do now any other options left or all door closed.

That's exactly why they refused it. He has daughters in his home country that are capable of taking care of him. If he had no other family in home country you would have had a much better chance to get approved. I don't think your sisters being "busy with their families" counts as a real H&C situation with CIC, they most likely see this as a personal choice for them not to take care of him.

I'm not sure if appeals process exists for H&C apps or what that process would be.

H&C decisions cannot be appealed. You can ask the Federal Court of Canada to review the decision: http://www.cic.gc.ca/english/refugees/inside/appeals-review.asp

The chances of success are likely very low given the father has family in his home country who can take care of him. But the OP can certainly try.

Couldn't you just apply under parent sponsorship in January 2018?? As long as you meet the financial requirements I don't see why not? The application processing times have really gotten a lot quicker!!

Will the age of his father be a negative factor if he applies again?

But as other posters said positive decision by the federal court is remote.....

It's a difficult situation indeed...health care costs would be huge in the coming days for his father in Canada without residency status....

I think CIC should know that in india parents are responsibility of sons not daughters.

Okay next try i will apply for parents sponsorship in 2017 quota but since his case is refused now should i apply myself or take help from lawyer.

I would say just apply yourself...

You're right - they're aware of cultural norms of different countries. However this isn't grounds for an H&C application.

Yes, they appreciate different cultures. But, that doesn't mean that Canada's laws must change becuase that's the way things are done in India, does it? There is a huge difference between having Indian tea and changing immigration laws to conform with Indian practices.

And I think you should know that next time, send in the proper forms. Also make sure you meet the 3 years of LICO + 30% income requirement before sponsoring.

And IRCC is also aware that in some countries you can have multiple wives. But it doesn't mean they will recognize it.

Scylla i was knowing about it but what should i do my father is old and i was not able to fulfill the conditions for parents and grandparents sponsorship
so i tried this and failed.

But i want to try again and again and now i can fulfill the conditions for parents and grandparents sponsorship so pls help me with your valuable suggestions
