I am a Canadian citizen and my husband is British. He has been living in Canada with for almost two years on a work permit. We were married this past October.
I would like to apply to sponsor my husband for permanent residency. It appears that if we apply within Canada he may have difficulty leaving the country during the application process. I have heard that if we apply at the Buffalo office this should not be a problem.
I have downloaded the forms to apply at the Buffalo office and they seem quite different than the ones if we are applying from within Canada. Are these the right forms to use?
Is my husband eligible to apply through the Buffalo office?
Will he be able to leave the country if we apply through the Buffalo office?
Is processing faster if we apply through the Buffalo office?
Inland sponsorship is different than outland so for sure the forms are different.
Your husband is eligible to apply for outland through Buffalo or London. He will be able to leave the country while doing outland.
The processing time for inland vs. outland is that inland is 6-7 months to get an open work permit, but total could be 12 to 18 months to get PR. For outland, it's first 24 days to approve sponsorship, then goes to Buffalo and takes 3 to 9 months there, average is 5 months to get PR. London is also about 3-9 months but average 4 months. The only difference between applying through Buffalo vs. London is that if he is called for an interview, he will have to go there.
You realize you are replying to a post from 2009. The processing times have changed since then and Buffalo is closed now. The Buffalo applications go to Ottawa now.
Right now, the CIC website gives 10 months for London based on 80% of applications being processed by that time. It could of course be faster.
You and your family are free to visit Canada as much as you like during the processing provided that your wife is visa exempt or has/gets a visa to visit.
There is a file available for download at http://data.gc.ca/data/en/dataset/427337d0-7c36-4fed-8428-c6a63f8c19b3 which shows processing times of various immigration classes by visa office up until the end of March this year. If you go to the tab called "PR-RP" and set it to spouses and partners and look for London, you will find that 20 and 30% of cases are done by 6 months, 50% by 7 months, 70% by 9 months and 80% by 10.
