Hi everyone I need emergency help and advise about Canadian student visa:
Here is my background: I am a Chinese citizen, I have completed one and a half year of study in a top university in Australia(Bachelor of Science). Last semester, I exchange to McGill University for 1 semester. I finished my study at 30th of April. I planed to travel to USA for 20 days from Montreal. However, I was stopped at US customs MAYBE because of the following reasons:
1. I did not sign up for EVUS( which is required for B1/B2 visa), officer told me if I signed up for EVUS all these bad things will not happen to me.(BIGGEST mistake in my life..)
2. I do not have a valid SIM card. I cancelled my SIM card in Montreal on 30th of April and planed to get a prepaid one in Boston. The officer let me to sign up for EVUS but I do not have Internet access( I do not have SIM card and there is not Wifi on the border).
3. I carried some document photos. I did not know why it will cause problem. I carried them in my wallet simply because I do not want waste them. It is common that I only need one photo but I have to print 8 photos because that is the only option post office offers. The officer asked me "Will you get new passport in US" and of course I denied because that is not my intention.
4. I lost my credit card. I lost my Australian bank card in Montreal. However I can call mastercard customer service to get emergency cash in Western Union. At the custom, I only have 300 usd but I explained I can get more after getting into US.(And I have my mother's credit card number and pin so I can book hotel online).
5. I cannot verify my Australia student visa. Australia student visa is electronic visa so there is no stamp on my passport. However I have my uni student card(which I think is useless for proving my state).
6. I am traveling alone. I have showed them my flight ticket from US to China. And I have receipt for hostel booking confirmation as well.
7. I did not tell them I might transfer to a Canadian University. I did not tell them simply because I do not think there is anything to do with traveling to US(also my offer was just conditional offer). They looked through my mail box and think I might try to hide this information.
8. Another thing I think worth to point out is they checked my phone for a while. I think they checked a lot of staff but ALL the apps and emails in my phone show I am a student and I did not lie any word to them. My mail box is about McGIll university and my Australian university. My social media is about discussion with other students. The photos is about me and my friends in Montreal and Australia. I do not think they can find anything about "illegally immigration in US" as that is the thing I did not plan to do.
So in the end they cancel my visitor visa, and decide I am " inadmissible pursuant to Section 212(a)(7)(A)(i)(I) of the INA", and I am "allow to withdraw application in lieu of expedited removal", and I "must obtain all necessary documents for entry prior to next application for admission, and I must provide proof of ties to my last country of residence".
I signed to the sheet to "voluntarily withdraw my application" and the US officer drives me to Canada custom. The Canadian officer ask me about my plan and I said " I might apply a new US visitor visa or just go home".
They told they will give me several days to apply for a new US visitor in Montreal or go home.
My origin Canadian visitor/student visa is valid until 30th of June but they attach a sheet on my passport and told me I have to leave before 31th of May.
And I left Canada to China yesterday.
My question is how this incidence will influence me to apply for Canadian student visa? I am worrying about they might think I am a bad guys and try to stay in Canada/US illegally. I do not thing I have done anything illegally to either Australia,Canada, China and US...
Should I go ahead to apply Canada student visa or just give up and continuing studying in Australia? I want to transfer to Canada simply because I find Canadian University is more challenging during my exchange semester. I have a good academic record as well.
