My partner and I are planning to move to Canada. We are currently in the middle east and went to see a consultant regarding our application. As per discussion, I have better chances of getting a PR than her. I am in a same sex relationship. My partner is married but not legally separated. They are not communicating for more than 2 years. Is there a way I can sponsor her?

If you have lived together continuously for 1 year, you are common-law and she can be included in your application.

If you are unable to live together, you will need to apply yourself. Once you are a PR, if she is able to get a TRV to Canada, you can become common-law. If she can't get a TRV, you can sponsor her as a conjugal partner.

We lived together for more than a year now. Our problem now is that she has been using her married name in her passport. What do we need to do?
If i may ask also what is common law? If this is applicable to us.

You will need to include your common-law partner in your app. It doesn't matter that she uses her married name.
