Help Required -> Permanent Resident - Spouse Sponsor

Hi,

I am getting married this April-May2010.My fiance is a Canadian Permanent Resident.
My fiance fly immediately after marriage and I would like to know the options available to fly to canada along with my husband after marriage.

We are planning to apply PR to me after reaching canada.

-> Please let me know the type of visa i need to get to fly with him after marriage?

-> Can we apply PR when staying in canada in someother temporary visa?

-> Is that possible to work while staying in canada in a temporary visa and PR is in progress??

You can apply for a TRV, a visitor visa, but chances are that you will be denied due to risk of overstaying.

If you don't get it, your husband will have to fly alone, apply to sponsor you and you will join him later when your PR comes through.

If you do get it, you can go to Canada together and in that case, you will have two ways of applying for PR, you can pick outland sponsorship through your country of nationality or inland sponsorship which is only processed in Canada.

Outland is usually faster but has the downside that if an interview is required, you would have to go to your home country for it. Inland is completely processed in Canada but has two huge downsides which is that you are not advised to leave Canada while it's in process because you may not be let back in and if that happens you lose your application and the 2nd one is that if an interview is required, it can delay your application by years.

Outland because it's fast, does not offer any work permit while you wait but inland offers a work permit after first stage approval which usually takes about 6 months. However, if an interview is required for inland, there will be no first stage approval or work permit so in a worst case scenario, you might spend 3-4 years stuck in Canada with no work permit or health care.

Can I apply for my husband's visitor visa from the Philippines even his PR application states "in process"??? Please advise... oh I dont know what to do... His passport was requested in Aug 4th 2009 and he sent it Aug 7th 2009 but we haven't heard since then... thank u!

Yes, you can apply for a TRV while his PR app is in process. However, it's most likely the TRV will be refused - they very rarely approve visas for people who have a spouse in Canada because they suspect the person will not return to their home country after the visa expires. Unless you can prove he has really strong ties in his home country (something that outweighs a spouse in Canada), then it will likely be refused. But the only thing you lose is the $75 processing fee, so it might be worth a shot. Sometimes they do get approved.
