My father-in law had applied to sponsor his daughter (my wife), but did not include me and our kids, because we got married and had kids way after the application was made, and he feared that adding us would delay the visa process. Now, the application for my wife has been approved and she's going to pick it up. So my question is, can she simply file for spousal sponsorship? Or what should we do?
You and your children must be added to your wife's application. She cannot use the visa that has been approved for her since her status on this visa is single, no dependents. If she lands in Canada and becomes a PR using the visa that has been approved for her now, the following things will happen:
1) She will never be able to sponsor you or your children for PR.
2) She will be committing misrepresentation by lying about her family status. Misrepresentation can result in having her own PR status revoked.
How was your wife sponsored by her father? Was she sponsored as a dependent family member? If so, then your wife no longer qualifies to be sponsored by her father since she is now married and no longer a dependent.
