Help!! Married and have a son born in Canada(Mother in Jail)

I'm Portuguese married in Canada in 2013 and I have a son born in Canada in September 2014.
The wife and mother of my son is my sponsor but she went to jail for a period of 18 months.
I'm raising my son alone for the last 3 months.It's not my first choice return with him to Portugal,
since he has a sister here.
My questions,
-Is my application gonna be refused?
-Can I get a status to be able to work and raise my son since I belive I can't take my son with me back
to Portugal?

What application? You are going to have to give a lot more information for people to actually help you. If you are referring to a spousal sponsorship app, your wife cannot sponsor you while in prison.

No, you cannot get any status in Canada based on your son.

yes spousal sponsorship and I understand she can't be my sponsor in that situation.
Do you know if I can get my soon with me to Portugal since the mother is not able to take care of him.

Is the mother willing to allow the child to go to Portugal? If so, you would just need to get a notarized letter of permission from her.

If she's not willing, then you would have to go through the courts to get permission to remove the child from Canada.
