It depends, but in many cases it's better to re-apply than to go through the appeal process if you want this to end soon. Why was the application rejected? Did you get a PFL? Please share some more context.
Thanks for your opinions been shared and in my case they refused me stating that I couldn't satisfy him during the interview. My application was filed in 2019 and got refused on May 5th. I know I can win the appeal if I have a lawyer, just that the money to hire the lawyer is a lot and I can't afford that.. so I will be glad if I can get a lawyer who can accept monthly installments. At least that will help out

The appeal process is a very long one. I would suggest you begin by ordering gcms notes, and carefully understanding why you were rejected.
If time is important for you, and you can address their concerns easily, sending a new application will very likely be the fastest route. There's a thread here about people waiting after the appeal, I'd suggest you find it and see what they're going through before you make your decision.

Thanks for ur opinion, how can I order for the gcms and how long would it take to receive it. I don't. Now the processing timeline for spousal application is 23 months which is almost 2years and an appeal will take longer but not 2years and moreover I'm not sure I have to go for any interview after I win an appeal. And the probability of getting approved after win the case is higher. At first I wanted to reapply but seeking ideas from the forum made me realise that the appeal is the best solution but it cost alot. It takes 8 months from the day of submitting an appeal to the hearing day according to the information I received from the people who went through it. But I stand to be corrected if I'm wrong

From experience because I recently went thru an appeal, once the appeal is won, there are no interviews. You redo medical, provide the police certificate and thats it. They process. Some people wait a long time for an appeal but dont forget there was a backlog due to Covid. The backlog is no longer there (depending on the IRB regional office). You can win an appeal but know IRB looks at your case different when you have a lawyer. Its unfair but it is what it is.

I guess this is an appeal before the immigration board and not the federal court. You can do it yourself if you know the appeal procedures. Secondly you ought to have ordered your notes to know the detail reasons so you can perfect your appeal if you decide to do it yourself. Remember the appeal is time bound within 15days of receipt of your refusal. If you are not comfortable with the procedures then it is better to find a lawyer and agreed on terms of payment that is favorable to you.

I jumped in the appeal group after responding to your reply before I realised you provided one. I Google her the other day and the reviews on her page was superb. I will reach them out today but since u have been through this before, I will be glad if u can give me ur contact for me to reach out to u to clarify few things for few minutes if u wouldn't mind pls. I'm a Ghanaian and if u are in gh, I think it will be easier to reach u out pls. My days are still running and I'm going kinda crazy over this thing
