Hi guys, I'm fairly new to this forum and I hope that people will take the time to help me out in my situation. Here is it, me and my husband converted to Islam (muslim) and got married here in saudi arabia 2 yrs ago. we also have a daughter who is turning 1 yr now. He is still legally married to his first wife in the philippines although that partnership ended 11 yrs ago and no communication ever since. The "ex-wife" and her family actually coerced my husband into marriage and since they were very young then, he was afraid that they might harm his family so he went ahead and signed the papers. after less than 2 yrs the marriage ended bec. she cannot handle the responsibilities of being a mother and left her son with him. My husband sought for custody through DSWD and he is now the legal guardian of his boy. At present, he got a job offer from a canadian employer in saskatchewan and he wants me, his son and our daughter to accompany him. My question is, how do we file for this? Can we apply for common law? and does he need to state in the application form that he was legally married in the philippines? by the way, we are also planning to seek for an annulment but that will take time. so please help us out.. thanks a lot

You should tell the truth, that he is still married but separated for many years and that you are in a common law partnership. Because he married the other woman first, your marriage to him is not legal in Canada. Being common law partners is just as good though. He will need to show that he has full custody of his son in order to take him along but you say he has paperwork for that so it shouldn't be a problem.
