Me and my spouse are Canadian Citizens.
Currently I'm in US with H1 status and my spouse is in Canada and she will be moving to US with me eventually.
1. In that case she don't have to apply anything to USCIS and simply get H4 status in port of entry with supporting documents?
2. Once she get the I94 in H4 status, she can send the documents to USCIS for EAD and come back to Canada on the same? Or she has to be in the USA until her EAD gets approved??
Please shed some light, since H4 EAD take long wait time and she don't want to take any break in her career.
I am in Canada, PR holder, applying for H1B visa (old visa is expired, I-140 approved). My son is 2.5 yrs old, is a Canadian citizen and first time he is applying for any kind of visa to moving to USA with me and continue living with me in USA.
In a similar situation, Canadian PR holder in Canada, Indian Citizen though. Did you take your son to the consulate to get his H4 or was it at the border?
I just wanted to update that I got my H4 yesterday at land port of entry and the process inside the building was quick. They asked for my spouse's I797 and marriage certificate and the whole process took less than 15 minutes. And we returned to Canada on same day without any issues.
