Hello Everyone,

My father expired in 2008 and my mother lives alone in India. I have a sister and she is married and lives in Maharashtra. My mother has visited Canada on Visitor Visa and Supervisa. We tried our luck for PR application under draw system, but no luck yet. Meanwhile, I heard that parent can get PR visa on humanitarian ground. I don't have much information on that. Has anyone applied permanent residence visa for their parents on humanitarian ground? Am I eligible for PR visa application under Humanitarian ground?

Any references or information on this matter would be highly appreciated. Thank you

A parent would need to apply for a normal H&C application. You would have to show what made your mother’s case exceptional compared to other parents waiting to qualify for PGP and why supervisa isn’t an option. The fact that you have a sister and she is in India and that she has a child in her home country will make it harder to get H&C approval. Being an only child and a widow sometimes helps an H&C case but doesn’t guarantee approval. There is a risk with H&C applications. Since your mother would declare her intention of wanting to remain in Canada forever she could face difficulties visiting if denied an H&C application.

H&C is not recommended for your situation. Since you have a sister living in your home country and you are not an only child, there is a very high chance of refusal. Once H&C is refused, this will normally cancel any valid super visas / TRVs and make it very difficult to get a new one approved in the future. Wait until you are selected through the parent / grandparent PR sponsorship lottery. That is the best path. You can certainly try filing an H&C application. However be aware that the chances of refusal will be high and the impact this will have on your mother's ability to visit you in Canada.
